Bush Erosion of Legitimacy Bush's claim as the legitimate president has been whittled away bit by bit:
  • Losing the popular vote.
  • Lack of clear standards in what constitutes a valid ballot.
  • Florida under and overvote unexamined.
  • Two questionable political favours from his brother Jeb, the governor of Florida: K. Harris discarded some counts and Florida Legislature speaker Tom Feeney threatened to use an obscure constitutional provision to ignore the election results in determining the electoral college members.
  • Rebublican canvassing officer Sandra Goard's criminal activity with absentee ballot applications.
  • Republican Supreme Court Justice Scalia in his addendum to the stay order admitted prejudice as his reason for granting the stay that would be irreparably harmful to Gore if Gore prevailed. Perhaps, some day, the Surpreme Court will boggle all our minds by reversing itself, or by Scalia retroactively recusing himself, leaving a 4-4 supreme court stalemate, a sort of remnant chesire cat smile. This is not totally fanciful. Democrats claim Scalia publicly stated that he would quit if Gore were elected, because his chances for advancement to the top post would be nil. Wyth a stalemate, the state of the decision would go into limbo, until a new Supreme court justice could be sworn in, a moderate Republican, perhaps another Souter. By the time the new justice broke the tie, President Bush's term of office would be over, so it does not matter much politicially what he decided. The justices could then repair the legal damage they had done earlier in stopping the Florida legistlature from attempting to use that almost-never-used ignore-the-election clause in the constitution.
  • Squirming about the pending Miami Herald Sunshine law full count. Bush is acting as if he too believes the count will not vindicate him.
